Residential Tenancies Update

We now have a much clearer picture from the Government about what we must have done to our Rental Investments and when we must have them done by.

When we rent a house to a Tenant we must now attach a “Healthy Homes Standards Statement” which declares to the Tenant a number of Legislation Requirements.

In our Statement we list what underfloor and ceiling Insulation is installed including the “R” rating.

We list what heating is in the house and if none quotes are to be obtained for Owners to consider.

We list what electrical ventilation there is in each bathroom and in the kitchen and if none quotes are obtained for Owners to consider.

Moisture Ingress must be addressed with polythene placed over bare dirt under enclosed subfloors, once again quotes are obtained for Owners to consider.

The Statement must be able to say Drainage complies with current Building Standards.

Draught Stopping, must be noted on your Statement, if there are any issues with draughts, we advise our Tenants to report to us any problems here as they have to live with it.

We also advise our Tenants of how many Smoke Alarms we have in a Property and their age, it is amazing how many are way past their use by date which is ten years old.

  • Smoke Alarm compliance has been with us since the 1st of July 2016.
  • Insulation must be completed by the 1st of July 2019.
  • Healthy Homes Standards Statements must be attached to every Tenancy Agreement from the 1st of July 2019.
  • Heating, Ventilation, Moisture Ingress, Drainage and Draught Stopping must be complied with by the 1st of July 2021.

The Ministry of Business, Innovation and Employment (MBIE) have an enforcement squad who randomly audit Rentals that have had Bonds paid to Tenancy Services to check that Landlords are complying with these requirements and substantial fines are being dished out.
